HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.1719 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/Accused under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.34 of of Nagarkurnool Police Station, Mahabubnagar District registered for the offences punishable under Sections 384, 387, 323, 324, 504, 506 read with 34 I.P.C.

2) When the matter came up for hearing, the respondent State represented by the Public Prosecutor submitted that in the above crime, the police concerned filed charge sheet after completion of the investigation and the learned Magistrate taken cognizance in the above crime and no cause survives for adjudication in this criminal petition and the same has become infructuous.

3) Recording the said submission, this criminal petition is disposed of without prejudice the rights of the petitioners for filing of any application under Rule 37 of Criminal Rules of Practice or Section 205 of Cr.P.C and the learned Magistrate after hearing the same shall pass necessary orders. Remedy is left open to the petitioners on the cognizance taken by the Magistrate from the police final report.
