ORDER

Heard learned counsel appearing for the petitioners and learned Government Pleader appearing for the respondents. Challenging registration of Cr.No.327 of 2016 by the 2nd respondent based on the complaint lodged by the maternal uncle of the victim, who tried to commit suicide by pouring kerosene, the present writ petition is filed.

The names of the petitioners were mentioned in the complaint. Perused the complaint and noticed that the allegations contained therein warrant investigation.

Learned Government Pleader submits that the victim subsequently succumbed to burn injuries and the matter requires investigation.

In the circumstances, this Court is not inclined to stop further investigation into the crime. However, the 2nd respondent shall follow due process of law, while investigating the crime, including compliance of provisions under Section 41-A of the Criminal Procedure Code, without arresting the petitioners. If the arrest of the petitioners is warranted, appropriate orders shall be obtained from the Magistrate concerned.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending, shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 7th March, 2017 rkk
