THE HON'BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION No.13446 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Civil Supplies for the State of Andhra Pradesh. It is the case of the petitioner that 440 bags of rice was seized from the lorry stationed in front of the non-trading rice mill of the petitioner, namely M/s. Vigneswara Traders Rice Mill, Kommerapudi Village, Sattanapalli Mandal, Guntur District, and a case under Section 6-A of the Essential Commodities Act was registered. Seeking release of the seized stock, the petitioner submitted an application before the Joint Collector & Additional District Magistrate, Guntur, the 2nd respondent. The grievance of the petitioner is that though he is willing to furnish bank guarantee to the value of the seized stock, no orders have been passed on the application of the petitioner. In the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondent to consider and dispose of the application submitted by the petitioner seeking release of the stock, within four weeks from the date of receipt of a copy of this order.

No order as to costs.
