THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3974 OF 2017 ORDER :

This writ petition is filed assailing the orders dated 26-042003 and 30-04-2016 passed in LCC No.1/RMM/1986, directing respondents 7 and 8 to surrender the land in question basing on the declaration of the petitioner's father by misapplying Sections 8 and 18 of the AP Land Reforms (Ceiling on Agricultural Holdings) Act, 1973, without impleading the petitioner as party respondent and without giving any notice as being illegal, arbitrary and violation of principles of natural justice.

Heard the learned counsel for the petitioner and the learned Asst. Government Pleader for Revenue.

It is fairly conceded by learned counsel on both sides that against the impugned order, appeal lies under sub-Section (3) of Section 20 of the AP Land Reforms (Ceiling on Agricultural Holdings) Act, 1973. In view of the availability of efficacious alternative remedy of filing appeal, this writ petition cannot be entertained and it is accordingly disposed of. However, it is open for the petitioner to file appeal under the said provision of law as stated supra. However, status-quo obtaining as on today shall be maintained. There shall be no order as to costs. However, As a sequel thereto, miscellaneous petitions, if any, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J Dated: 06-02-2017 Nrg
