HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 22745 of 2016 ORDER:

Heard learned counsel for the petitioners, Government Pleader for Roads and Buildings, Government Pleader for Central Government, Government Pleader for Revenue and Sri G.Seshadri Rao, learned counsel appearing for respondent No.10. With the consent of all the parties, the writ petition is taken up for disposal at the admission stage itself. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in marking the petitioner's house and site bearing Plot Nos.1 and 2 to an extent of Ac.0.08 cents in Sy.No.70/2 situated in Erragondapalem Village and Mandal, Prakasham District for the purpose of road widening, as illegal, arbitrary and violatives of principles of natural justice; and consequently to direct the respondents not to form any road through any portion of the petitioner's property.

Though various grounds are raised learned counsel for the petitioners restricts his prayer seeking a direction to the respondents to follow due process of law.

Having regard to the facts and circumstances of the case and without going into the merits of the case, the present writ petition is disposed of, directing the

respondents not to interfere with the subject properties in the context of road widening except in accordance with the due procedure laid down by law. No order as to costs.
