THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11632 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.242 of 2023 on the file of Kachiguda Police Station, Hyderabad, registered for the offences under Sections 307 and 324 of IPC. 2.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the petitioner is that he attacked the victim who is related. The petitioner is working as tea maker in a hotel. It is alleged in the complaint that the petitioner quarreled with the victim on 28.09.2023 and during the said quarrel, this petitioner had brought a knife and attacked the victim.

On instructions, learned Additional Public Prosecutor would submit that the petitioner received one laceration injury which is simple in nature.

Keeping in view that only one injury was received by the victim, that too simple one and this petitioner being in jail since
30.09.2023, the relief of regular bail can be granted subject to following conditions:- i) The petitioner/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, i.e., one local surety and one from the native place, for a like sum each to the satisfaction of the IV Additional Chief Metropolitan Magistrate, Hyderabad. ii) The petitioner/Accused after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of four weeks for the purpose of investigation and thereafter, as and when required.
(iii) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.
Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
