THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17244 OF 2016 ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader for Home (AP) and with consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.

2 . The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents, more particularly respondents 3 and 4 in interfering with the civil matters by sending constables, and calling the petitioners to police station frequently and threatening them to settle the civil disputes with respondent No.5 in respect of property admeasuring Acs.16.00 cents covered by R.S.No.416/2B2 situated at Rajahmundry, East Godavari District, as illegal and arbitrary.

3. Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to the respondents 3 and 4 not to interfere with the civil dispute except in accordance with law.

4. Learned Government Pleader for Home submits that the allegations made in the writ petition are all false and that the respondents will follow the due process of law while summoning the petitioners.

5. Since the matter is not decided on merits, it may not be necessary to issue notice to the unofficial respondent.

6. Having regard to the circumstances stated above and without going into the merits of the case, the Writ Petition is disposed of directing the respondents, more particularly respondents 3 and 4, not to summon the petitioners to the police station except following the due process of law. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
