THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD M.A.C.M.A.No. 2153 of 2009 JUDGMENT:
This appeal is directed against the Judgment and decree dated 22.01.2007 passed by the I Additional Motor Accidents Claims Tribunal, Nizamabad (for short 'the Tribunal), in O.P.No.1453 of 2001 whereby the Tribunal disagreed for granting compensation that the deceased being the owner of lorry bearing No. AP12U 2490 is not covered under Ex.B.1 policy and thereby the deceased is not a third party to the accident.
For the sake of convenience, the parties to this appeal will hereinafter be referred as they are arrayed before the Tribunal.
Now in this appeal, it is the contention of the learned Counsel for appellants/claimants that the Tribunal erred in allowing the claim petition.
Considering the facts and circumstances of the case that the deceased is owner of the crime vehicle and not third party to the Ex.B.1 police, the appellants are not entitled for any compensation as rightly considered by the Tribunal. Therefore, I see no grounds to interfere with the judgment passed by the Tribunal at this stage and the appeal is liable to be dismissed.
Accordingly the appeal is dismissed, confirming the Judgment and decree dated 22.01.2007 passed by the I Additional Motor Accidents Claims Tribunal, Nizamabad, in O.P.No.1453 of 2001. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this appeal shall stand closed.
