Heard.

The present writ petition is directed against the order of the R1A.P.Co-operative Tribunal, Vijayawada, dated 26-11-2014 in M.A.No.47 of 2014 in O.A.No.92 of 2015. Respondents 2 and 3 had approached the Tribunal questioning the action of the petitioner's bank in removing them from the membership of the petitioner's bank basing on Resolution No.8 of the petitioner's General Body Meeting, dated 25-09-2014. The said action was questioned on various grounds including that it is contrary to the Act and byelaws and merely on the basis of Circular of the Bank, which is not in conformity thereof, the membership of respondents 2 and 3 in the petitioner's bank was removed.

The Tribunal considered the entire matter and after hearing the arguments of both sides, through the impugned order, suspended the Resolution of the Bank.

Though the present writ petition is directed against the said order, keeping in view that the Tribunal itself has intended to dispose of the appeal before the end of February, 2015, in my view, it is neither expedient nor justifiable to entertain this writ petition, so as to decide the interlocutory nature of the order, which is impugned herein. In my view, it would be appropriate in the interest of both the parties that the appeal itself is heard and disposed of by the Tribunal at an early date as expressed in the impugned order itself.

Hence, while confirming the order impugned, the 1st respondent is directed to hear and dispose of O.A.No.92 of 2014, in accordance with law, as expeditiously as possible, preferably by the end of March, 2015, after hearing all the parties.

Accordingly, the Writ Petition is disposed of. No order as to costs.

The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
