THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9534 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are Accused No.1 to 7 in the event of their arrest in Crime No.108 of 2022 on the file of Station House Officer, Garla Bayyaram Police Station, Mahabubabad District, registered for the offence punishable under Section 306 read with Section 34 of Indian Penal Code. 2.

Heard learned counsel for petitioners/Accused Nos.1 to 7 and learned Additional Public Prosecutor for respondent-State. Perused the record.

The facts of the case are that the de facto complainant filed a written complaint alleging that her daughters were taken by her elder sister for lunch along with other relatives. During the said outing for lunch, these petitioners allegedly made harsh remarks and abused the de facto complainant's sister who was taking care of the de facto complainant's children. One of the daughter namely Navya who is eldest daughter of the de facto complainant committed

suicide for the reason of these petitioners abusing them and their mother's elder sister.

On perusal of the record, it appears to be a dispute in the family regarding the raising of kids and also the property. However, the petitioners conduct resulted in 17 years old girl loosing her life by committing suicide. However, in the said circumstances, for the reason of there being an altercation and the petitioners indulging in abusing the other family members, these petitioners prayer for anticipatory bail can be considered on conditions. 5.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.1 to 7 shall be enlarged on bail in the event of their arrest subject to the following conditions: i) The petitioners/Accused Nos.1 to 7 are directed to surrender before the Station House Officer, Garla Bayyaram Police Station, Mahabubabad District within ten (10) days from today, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with two sureties for a like sum each, to its satisfaction.

ii) On such release, the petitioners/Accused Nos.1 to 7 shall appear before the concerned Station House Officer on everyday at 10.00 AM for a period of one month and thereafter as and when required for the purpose of investigation.

iii) The petitioners/Accused Nos.1 to 7 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. Miscellaneous applications, if any, pending shall stand closed. _____________ K.SURENDER, J Date: 07.11.2022 ns
