HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.132 of 2016 ORDER:

This petition is filed to withdraw O.P.No.618 of 2015 from the file of Judge, Family Court-cum-III Additional District Judge at Warangal and transfer the same to Judge, Family, Court, Ranga Reddy at L.B.Nagar.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 23.04.2004 at Pingili Function Hall, Hanamkonda, Warangal as per Hindu rites and caste custom and respondent has deserted her in the month of November, 2006. She stated that she filed complaint under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act and charge sheet was filed as C.C.No.200 of 2010 on the file of VII Additional Judicial First Class Magistrate, Warangal and that she also filed M.C.No.44 of 2007 before the District Judge, Warangal and the same was also disposed of. She stated that petitioner and respondent are residing within the jurisdiction of Family Court, Ranga Reddy. She stated that she has life threat in the hands of respondent and his family members at Warangal and she being a lady it is difficult for her to travel from Ranga Reddy to Warangal by undertaking journey covering 165 Kms and for that reason she sought transfer of O.P.No.618 of 2015 to Family Court, Ranga Reddy at L.B.Nagar.

3. This Court permitted petitioner to take out personal notice to respondent through his advocate on record in the lower Court and in compliance of the said order, memo was filed along with postal acknowledgment and track record, as per which notice sent

to advocate for respondent was delivered on 12.04.2016. In spite of that neither the respondent appeared in person or through any advocate.

4. Heard advocate for petitioner. Perused the affidavit filed in support of the petition.

5. Considering the reasons stated in the affidavit filed in support of the petition and also considering the convenience of the wife, O.P.No.618 of 2015 is withdrawn from the file of Judge, Family Court-cum-III Additional District Judge, Warangal and transferred to Judge, Family Court, Ranga Reddy at L.B.Nagar for disposal in accordance with law.
