THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4096 OF 2016 ORDER:
This petition is filed by the petitioner-accused No.1 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.1554 of 2014 on the file of the II Metropolitan Magistrate, L.B. Nagar, Cyberabad.
Heard and perused the material available on record. The petitioner along with other accused is alleged to have committed the offence punishable under Sections 420 and 120(B) r/w 34 IPC. It is alleged that the de facto complainant purchased the land belonging to the petitioner under a registered agreement of sale-cumGeneral Power of Attorney and paid Rs.29 lakhs and basing upon the said agreement, the de facto complainant along with his other partners entered into an agreement with A2 and A3 for sale of the above said property and received Rs.8 lakhs out of Rs.55 lakhs. Instead of paying the remaining amount, A2 and A3 conspired with A1 and got cancelled the agreement of sale executed in favour of the de facto complainant so as to cheat him.
Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to grant the relief sought by the petitioner.
At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court. Considering the above submission, the presence of the petitioner before the trial Court is dispensed with except on the dates when his presence is specifically required by the trial Court. The petitioner is directed to be represented by a Counsel before the trial Court on all hearing dates.
Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
