HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.33945 OF 2017 O R D E R :

This writ petition is filed challenging the proceedings dated 20.07.2017 issued by the 4th respondent vide Rc.No.161/2017/EGS/HR, making false allegations against the petitioner thereby suspended the petitioner from service pending enquiry and the petitioner was also asked to submit explanation. In pursuance of the same the petitioner submitted detailed explanation dated 26.07.2017 to the 4th respondent denying the allegations made against her. But, as on today no orders are passed and the petitioner is being kept under suspension. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner and Sri MSR.Chandramurthy, learned Standing Counsel for the 4th respondent.

As far as suspension is concerned, normally, this Court will not interfere with the order of suspension pending enquiry unless it is without jurisdiction, arbitrary and non application of mind. The truth or otherwise of the allegations made against the petitioner have to be gone into the enquiry to be conducted. Since the petitioner has already submitted explanation, the competent authority is directed to consider the same and take action within a period of four weeks from

the date of receipt of a copy of this order. Failing which, the respondents shall reinstate the petitioner into service. Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel to disposal of the writ petition, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
