THE HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No. 875 of 2010 Order:
This Criminal Petition is filed, under Section 482 of the Code of Criminal Procedure, 1973, by the petitioners/A2 and A3, seeking to quash the proceedings pending against them in CC No.860 of 2009 on the file of the learned IX Metropolitan Magistrate, Kukatpally, Ranga Reddy District, for the offences punishable under Sections 498(A), 506 IPC and Sections 3 and 4 of Dowry Prohibition Act.
2. When the matter is taken up for hearing, it is represented that since there was no stay in the Criminal Petition, the trial in the said CC No.860 of 2009, which was subsequently renumbered as CC No.3631 of 2013 on the file of the II AJCJ-cum-XIX Metropolitan Magistrate, Cyberabad, Kukatpally, at Miyapur, was proceeded with and the CC has been disposed of and, in view of that, nothing survives for adjudication in the Criminal Petition and the matter has become infructuous. A copy of the judgment passed in CC No.3631 of 2013 is also produced and the same is placed on record.
3. Having regard to the facts and circumstances of the case, the Criminal Petition is dismissed as having become infructuous.
4. As a sequel thereto, the miscellaneous applications, if any, pending in the Criminal Petition shall stand closed. __________________ M.S.K. JAISWAL, J.
