THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.1012 OF 2017 ORDER:
The writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue a writ or order or direction in the nature of Writ of Mandamus declaring the action of the 4th respondent issued proceedings vide Letter No.SE/CO/GNT/DE.T/Civil/F.Doc/D.No.04/17 dated 2.1.2017 directing to vacate the premises of PSCC Polls Center, Sangadigunta, Guntur by removal of T & P materials is illegal, arbitrary and consequently direct the respondents not to interfere with the possession and enjoyment of the above said premises of the petitioner."

At the time of hearing, it is submitted by Sri Naram Nageswara Rao, learned counsel appearing for the petitioner, that the time granted by the respondents herein for vacating the premises came to an end on 14.2.2017 as per the impugned letter bearing No.SE/CO/GNT/DE.T/Civil/F.Doc/D.No.04/17, dated 02.01.2017, and a request is made by the learned counsel for the petitioner that reasonable time may be granted for vacating the premises. It is also submitted by the learned counsel that in view of certain practical difficulties, the petitioner herein is asking the said time for vacating the premises.

No instructions have been received by Smt Jagarlamudi Koteswari Devi, learned Standing Counsel appearing for respondent Nos.2 to 4, so far.

Having regard to the nature of controversy and keeping in view the request made by the learned counsel for the petitioner, this Court is of the considered opinion that the ends of justice would be served if the petitioner is granted fifteen days time from today to vacate the premises.

For the aforesaid reasons, the Writ Petition is disposed of, granting fifteen (15) days time from today to the petitioner for vacating the subject premises as indicated in the letter bearing No.SE/CO/GNT/DE.T/Civil/F.Doc/D.No.04/17, dated 2.1.2017. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
