HON'BLE THE CHI EF JUSTI CE SRI THOTTATHI L B. RADHAKRI SHNAN TRANSFER CI VI L MI SCELLANEOUS PETI TI ON No.545 of 2017 ORDER:

This is an application filed by the wife for transfer of O.P.No.777 of 2016 pending in the Family Court, Vijayawada, Krishna District.

The respondent husband filed the aforesaid O.P. for restitution of conjugal rights. While that O.P. is filed in 2016, the wife has shown that she delivered a girl child on 13.08.2016 within the limits of the Greater Hyderabad Municipal Corporation, as evidenced by the birth certificate. Therefore, she has to take care of an infant.

Apart from the aforestated facts, it is noticed that the wife has instituted a Domestic Violence Case No.17 of 2017 in the Court of VI Additional Metropolitan Magistrate, Cyberabad at Medchal.

On the aforesaid factual premise and taking into consideration that the respondent husband is a person in employment and would therefore have the necessary financial ability to contest the case in Ranga Reddy District and the wife has shown sufficient grounds for transfer of O.P.No.777 of 2016

HCJ TR.CMP.No.545 of 2017 from the Family Court, Vijayawada, Krishna District, to the Family Court, Ranga Reddy District, this application for transfer is eligible to be allowed.

In the result, this Transfer Civil Miscellaneous Petition is allowed transferring O.P.No.777 of 2016 from the Family Court, Vijayawada, Krishna District, to the Family Court, Ranga Reddy District.

Pending miscellaneous petitions, if any, shall also stand disposed of.
