SIVA SANKARA RAO CIVIL MISCELLANEOUS APPEAL No.502 of 2010 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) This Civil Miscellaneous Appeal arises out of the interlocutory order passed in I.A.No.2177 of 2009 in O.S.No.123 of 2009 on the file of the learned IV Additional District Judge, East Godavari District, Kakinada.

Registry has now placed a note before us that the suit, O.S.No.123 of 2009, was itself disposed of on 18.09.2012. In that view of the matter, this Appeal arising out of the interlocutory order passed in the said suit, no longer survives for consideration on merits.

The Civil Miscellaneous Appeal is accordingly dismissed. Interim order dated 29.06.2010 shall stand vacated. It is open to the parties to approach the trial Court in relation to any amounts deposited before the trial Court pursuant to the interim order passed in this Appeal.

Pending miscellaneous petitions, if any, shall also stand dismissed in the light of this final order. No order as to costs.
