HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL PETITION No. 213 of 2017 ORDER:

Vide present petition, the petitioner/Accused No.1 seeks a direction, thereby to relax the conditions imposed on him in Crl.M.P.No.4666 of 2016 dated 02.01.2017 on the file of learned II Additional Junior Civil Judge-cum-XIX Metropolitan Magistrate, Kukatpally, at Miyapur, Cyberated.

While enlarging the petitioner/Accused No.1 on bail, the Metropolitan Sessions Judge directed the petitioner to execute personal bond for a sum of Rs.5,000/- with two sureties each for the like sum to the satisfaction of the Court concerned. The learned Judge further directed the petitioner to deposit his Passport and not to leave the State of Telangana. Learned Counsel appearing on behalf of the petitioner/Accused No.1 submits that the conditions imposed by the lower Court while granting bail are onerous and contrary to the orders of this Court dated 29.12.2016 passed in Writ Petition No.46244 of 2016 whereby investigation officer was directed to complete the investigation and file final report in accordance with law without arresting the petitioner & other co accused. This Court further directed the petitioner and his co-accused to appear before the Station House Officer concerned and execute personal bonds for a sum of Rs.5,000/- each with one surety each for the like sum

for their appearance as and when required for the purpose of investigation.

In view of the foregoing discussion and keeping in view the order of this Court noted herein above, the petitioner/Accused No.1 is at liberty to move through out the country wherever he wants to go.

However, it is made clear that if the petitioner/Accused No.1 wants to leave the Country, he shall obtain prior permission from the Court in regard thereto. With the above modification in the order of the Court below, this Criminal Petition is partly allowed.

Miscellaneous petitions pending consideration if any in the Criminal Petition shall stand closed in consequence. -------------------------------------------- JUSTICE SURESH KUMAR KAIT DATED 5th January, 2017.
