HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 19910 of 2003 ORDER:

When the matter is taken up for hearing, learned counsel for the respondent workman has submitted that the amount payable to the respondent workman was paid, in pursuance of the orders passed in M.P.No.190 of 2000 dated 30.04.2003 and in view of the same, the cause in the writ petition does not survive.

Learned counsel for the petitioner has submitted that when the respondent workman was convicted in a criminal case, the question of granting relief to him would not arise.

Having considered the submissions made by the parties, this Court is of the considered view that the amount as ordered by the Labour Court in M.P.No.190 of 2000 was deposited before the Labour Court and the respondent workman was permitted to withdraw the said amount. In view of the same, no further orders are necessary in the writ petition.

Accordingly, the writ petition is closed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
