HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19102 OF 2011 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the 5th respondent in recommending to issue NOC in favour of 7th respondent pertaining to land of 1st petitioner in Survey No.685, admeasuring Ac.0.27 cents situated at East Gudur Village, Gudur Mandal, SPSR Nellore District vide report dated 02.04.2011 as illegal and arbitrary and for a consequential direction to the official respondents to conduct necessary enquiry on the representations of the petitioners as directed by the Collector vide R.C.E.2706/2011, dated 30.05.2011 by taking into consideration of latest representation dated 21.06.2011 and documents enclosed by the petitioners.

Learned counsel for the petitioners submits that the application of the 7th respondent for grant of NOC is rejected and the same is not disputed by the learned counsel appearing for the 7th respondent. In view of the above, nothing survives for adjudication in this writ petition. Accordingly, the writ petition is dismissed as infructuous. However, this will not preclude the aggrieved party in challenging the said rejection order and the respondent authorities from conducting further enquiry, if any. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
