THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36355 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the second respondent in not providing police protection in implementing the injunction order, dated 28.09.2016 passed in I.A.No.829 of 2016 in O.S.No.213 of 2016 on the file of the Additional Junior Civil Judge, Malkajgiri, Ranga Reddy District, as illegal and arbitrary and consequently, to direct the second respondent to provide police protection. Heard and perused the material.

Learned counsel for the petitioner submits that the second respondent is not providing police protection to implement the injunction order, dated 28.09.2016 passed in I.A.No.829 of 2016 in O.S.No.213 of 2016 on the file of the Additional Junior Civil Judge, Malkajgiri, Ranga Reddy District, at the instance of the third respondent, and as such, seeks a direction to the second respondent to provide police protection. Considering the facts and circumstances of the case, the petitioner is directed to submit a representation to the second respondent seeking police protection to implement the injunction order stated above, and on such representation, the second respondent is directed to consider the same and if the second respondent is of the view that there is necessity to give police protection for implementation of the injunction order, he is at liberty to do so.
