HON'BLE SRI JUSTICE A. SHANKAR NARAYANA TRANSFER CRIMINAL PETITION No.93 OF 2017 ORDER:

The present Transfer Criminal Petition, under Section 407 of the Code of Criminal Procedure, 1973, is filed requesting to withdraw C.C.No.235 of 2009 from the file of Judicial Magistrate of First Class, Salur, Viziangaram District, and transfer the same to any other Sessions Division in Viziangaram District.

2. In fact, the petitioner herein is challenging the order, dated 30.03.2017, passed in Transfer Crl.M.P.No.489 of 2016 by the learned Sessions Judge, Viziangaram, whereby and whereunder, the learned Sessions Judge, while dismissing the said petition, directed the learned Judicial Magistrate of First Class, Salur, to dispose of the aforesaid Calendar Case within 15 days from the date of receipt of a copy of the order.

3. Sri R. Siva Sai Swaroop, learned counsel for the petitioner, would, ofcourse, draw the attention of this Court to the aforesaid direction given by the learned Sessions Judge and would submit that 15 days' time granted by the learned Sessions Judge is very arduous and, therefore, seeks extension of time, rather than questioning the order itself.

4. There appears to be some reason in the submission made by the learned counsel for petitioner. Therefore, the learned Judicial

Magistrate of First Class, Salur, is directed to dispose of C.C.No.235 of 2009 within two months from the date of receipt of a copy of this order, instead of 15 days' time frame fixed by the learned Sessions Judge.

5. Accordingly, the present Transfer Criminal Petition is disposed of. Miscellaneous Petitions, if any, pending in this Transfer Criminal Petition, shall stand closed.
