THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9501 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused in the event of his arrest in Crime No.217 of 2022 on the file of Station House Officer, Haveliganpur Police Station, Medak District, registered for the offence punishable under Section 304-II Indian Penal Code.

Heard learned counsel for petitioner/Accused and learned Additional Public Prosecutor for respondent-State. Perused the record.

The allegation against this petitioner is that he had put live wires fencing around his land. One of the villagers found that electricity was passing through the fields of the petitioner and discontinued the said supply. One person came into contact with the live wires and died.

On the basis of the complaint of connecting electric supply to the fencing and consequently a person who came into contact has died, for which reason, the complaint was registered.

Learned counsel for the petitioner submits that the petitioner has absolutely no intention and only to keep the pests away from his land, the said fencing was given electric connection. 6.

In the said circumstances, since the petitioner/Accused did not have intention of causing death, he can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused shall be enlarged on bail in the event of his arrest subject to the following conditions:

i) The petitioner/Accused is directed to surrender before the Station House Officer, Haveliganpur Police Station, Medak District within ten (10) days from today, and on such surrender, he shall be enlarged on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with two sureties for a like sum each, to its satisfaction.

ii) On such release, the petitioner/Accused shall appear before the concerned Station House Officer on everyday at 10.00 AM for a period of one month and thereafter as and when required for the purpose of investigation.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
