HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO TRANSFER CRIMINAL PETITION No.208 of 2017 ORDER :

This petition is filed by the petitioner under Section 407 Cr.P.C., seeking transfer of C.C.No.37 of 2017 on the file of the III Metropolitan Magistrate, Ranga Reddy District to XXII Additional Chief Metropolitan Magistrate, Secunderabad, to try along with C.C.No.234 of 2017. Heard the learned counsel for the petitioner and the learned Public Prosecutor representing the State and perused the grounds urged in the quash petition.

Practically, there is nothing to transfer the case, as majority of the witnesses of the charge sheet are within the jurisdiction of the Medipally Police Station. Merely because the so called disclosure from the recovery panchanama of accused covered by several crimes, of which some are pending in Secunderabad Court, is not a ground to transfer the said C.C. Needless to say, any such evidence of the mediators if at all examined in one case, the deposition of them if necessary can be obtained and confronted, if they want to say something more in another case.

Accordingly, the Transfer Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending shall stand closed.
