Common Order:

These two Civil Miscellaneous Appeals and the Civil Revision Petition arise out of Common Order, dated 23.03.2011, in IA.Nos.948 & 949 of 2010 in OS.No.196 of 2010 and IA.No.671 of 2010 in OS.No.162 of 2009, on the file of the Court of the learned Principal District Judge, Nellore.

Mr.P.Srinivasa Reddy, learned Counsel for the appellants in the Civil Miscellaneous Appeals and the revision petitioners in the Civil Revision Petition, addressed letter, dated 03.02.2015, to the Registrar (Judicial) of this Court, wherein he has stated that as the suits are ready for trial, his clients want to withdraw both the Civil Miscellaneous Appeals and the Civil Revision Petition.

Today, at the hearing, the learned Counsel has submitted that OS.No.196 of 2010 was originally filed in the Court of the Principal Junior Civil Judge, Kovvur, and numbered as OS.No.81 of 2003 and that subsequently, the same was transferred to the Court of the Principal District Judge, Nellore, and re-numbered as OS.No.196 of 2010 to be tried along with OS.No.162 of 2009 pending on its file. He has, therefore, requested that the Civil Miscellaneous Appeals and the Civil

Revision Petition may be dismissed with a direction to the learned Principal District Judge, Nellore, to dispose of the suits expeditiously.

In the light of the above-noted submissions of the learned Counsel, both the Civil Miscellaneous Appeals and the Civil Revision Petition are dismissed as withdrawn with the direction to the lower Court to dispose of the suits within four months from the date of receipt of this order. As a sequel to dismissal of the Civil Miscellaneous Appeals and the Civil Revision Petition, the Miscellaneous Petitions, pending if any, stand dismissed as infructuous.
