This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioners, who are arrayed as accused Nos.1, 3, 5, 6, 12 and 14 in Crime No.947 of 2025 before the Alwal Police Station, Cyberabad Commissionerate.

The brief facts of the case are that on 16.09.2025, a complaint was lodged by ASI of Police, Alwal Police Station, stating that on 15.09.2025 at around 20:00 hours, a group of about 18 persons from Boinpally area, armed with hockey sticks and iron rods, created nuisance near Hasmathpet, attacked the AIMIM Office, damaged property, and assaulted certain persons, causing injuries. Basing on the said complaint, a case in Crime No.947 of 2025 was registered under Sections 191(2), 191(3), 118(1), 324(4)(5), 333, 351(3) r/w 190 of the BNS.

Heard Sri K. Muralidhar, learned counsel appearing on behalf of the petitioners as well as Sri D. Arun Kumar, learned
Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the allegations were false, fabricated, and politically motivated, made at the instance of rival party members to tarnish the reputation of the petitioners who were active political workers and that the FIR contained only general and vague allegations without attributing any specific overt act to the petitioners, and no independent witness or corroborative material supported the complaint. He further submitted that the petitioners were law-abiding citizens with permanent residence and no criminal antecedents, and they were ready to cooperate with the investigation. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against the petitioners are serious in nature and that the victims sustained grievous injuries. Further, the investigation was not yet completed. At this stage, granting of pre-arrest bail to the
petitioners does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that two persons sustained injuries in the said incident, and one of them suffered a fracture injury. It is also seen that one of the petitioners himself stated that his aspirant is contesting in the forthcoming elections, and in connection therewith, they created nuisance at the party office. Further, the investigation is still in progress. Considering the nature and gravity of the allegations and the stage of investigation, at this stage, this Court is not inclined to grant pre-arrest bail to the petitioners and the same is liable to be dismissed.

Accordingly, this Criminal Petition is dismissed. Miscellaneous applications, if any pending, shall stand closed.
