HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.204 of 2016 ORDER:

This petition is filed to withdraw O.P.No.1485 of 2011 from Family Court, City Civil Court, Hyderabad and transfer the same to Family Court, Secunderabad.

2. Husband filed this petition. According to his affidavit, presiding officer started pressurizing him for settlement of case and also pressurizing him to pay monthly maintenance to wife and children and that made him to file this transfer petition on the ground that justice may not be done to him before Family Court, Hyderabad.

3. Wife filed counter affidavit disputing those allegations and contended that transfer petition is filed at the stage of arguments only to protract proceedings.

4. Heard both sides.

5. Both counsel submitted arguments supporting the respective contentions of their parties. This Court called for remarks of presiding officer enclosing affidavit filed by petitioner.

6. Considering material available on record including affidavit and counter affidavit of parties and remarks of presiding officer, I am of view that there are absolutely no grounds to consider request of petitioner/husband for transfer of case from Family Court, Hyderabad to Family Court, Secunderabad. However, trial Court shall dispose of O.P in accordance with law without being influenced by any of the allegations made by petitioner/husband in his affidavit filed in support of transfer petition preferably within one month from the date of receipt of a copy of this order.

7. Accordingly, the Transfer Miscellaneous Petition is dismissed

with the above direction. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
