.....RESPONDENT Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus declaring as illegal, and arbitrary, the tender and Auction Notice dated 19.12.2007 published in Telugu Daily Andhra Jyothi under section 13(4) and (12) of the Securtisation Act and Rules 8 and 9 of Security Enforcement Interest Rules in pursuance of Demand Notice dated 26.8.2006 under section 13(2) of the Act and issue a consequential direction to the Respondent Bank not to interfere with the petitioners property in any manner and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.

The petition coming on for hearing, upon perusing the petition and the affidavit filed in support there of and upon hearing the arguments of Sri.K.Srinivasa Rao, Advocate for the Petitioner. Notice before admission, list the matter after three (03)

weeks.

In view of the facts and circumstances, interim stay on condition of deposit of half of the amount demanded within a period of four (04) weeks.
