THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.2046 of 2017 ORDER:

This criminal petition is filed to reduce the surety amount imposed by the Metropolitan Sessions Judge-cum-I Additional District and Sessions Judge, Visakhapatnam, in Crl.M.P.No.3899 of 2016 dated 24.11.2016 whereby the petitioner/ A.6 shall be released on bail on execution of personal bond for a sum of Rs.50,000/ - with two sureties who shall furnish a fixed deposit of Rs.50,000/ - each drawn in the name of the Court and submit the same to the satisfaction of Additional Judicial First Class Magistrate, V.Madugula.

The main contention of the petitioner before this court is that the petitioner is eking out his livelihood by doing labour work and not in a position to furnish fixed deposit for Rs.50,000/ -. Therefore, taking into consideration the financial capacity of the petitioner, fixed deposit for an amount Rs.50,000/ - is reduced to Rs.25,000/ -(Rupees Twenty Five Thousand only) by the petitioner.

With the above modification, the criminal petition is allowed.
