THE HONOURABLE SRI JUSTICE C. PRAVEEN KUMAR And THE HONOURABLE Ms. JUSTICE J.UMA DEVI W.P.No.23000 of 2010 JUDGMENT: (per Hon'ble Sri Justice C.Praveen Kumar) 1) The present Writ Petition came to be filed seeking issuance of writ of Mandamus declaring the action of the second respondent in not initiating any action pursuant to the order of District Land Grabbing Tribunal, Anantapuramu, in LGOP No.114 of 1984, dated 10.02.1987, which was confirmed by the Appellate Tribunal, Hyderabad in S.R.No.91 of 1990, dated 27.11.1991 and consequential orders in I.A.No.548 of 1999 in O.P.No.114 of 1984, dated 10.02.1987, was allowed, as illegal and arbitrary.

2) By an order dated 06.03.2018, this Court passed the following order:

" The present writ petition came to be filed seeking implementation of the order passed in LGOP No.114 of 1984, dated 10.02.1987.

The only argument advanced by the learned counsel for the petitioner is that inspite of efforts made by them, the Revenue Divisional Officer is neither responding nor implementing the order dated 10.02.1987.

Learned Government Pleader, obtained instructions dated 22.02.2018, wherein the RDO, Anantapuramu, stated that connected file in the office of Tahsildar, Ananthapuramu, is under search and necessary action would be taken by the office after ascertaining those

files. Hence, he sought one month time to furnish remarks on the petitioners' affidavit.

Inspite of the order passed in the year 1987, strangely, the RDO is now seeking time to furnish remarks, instead of implementing the order dated 10.02.1987. It appears that he has no concern for orders passed by the Court.

At this stage, learned Government Pleader sought time to take necessary steps. Hence, post on 13.03.2018, by which date, the concerned RDO shall implement the order of the Land Grabbing Court dated 10.02.1987, passed in LGOP No.114 of 1984 in default of the same, he shall appear before this Court on 13.03.2018, to which date the present case stands posted."

3) Pursuant to the said orders passed by this Court on 06.03.2018, learned Government Pleader placed on record the instructions received from the second respondent, which reads as under: " It is submitted that in pursuance of Form-V notice, the Tahsildar, Ananatapuramu, has issued notice under Section 15(5) of A.P.Land Grabbing Prohibition Rules, 1988, vide his Rc.No.308 of 2018, dated 08.03.2018. The Tahsildar, Anantapuramu has submitted Form-VII after eviction of the occupied respondents from the sites on 10.03.2018" .

4) From the above it is clear that in compliance with the orders of the Hon'ble Court, all the 11 land grabbers/ respondents in this case were evicted from the site situated in Survey No.308 extent 0.26 cents (counsel clarified it to be 0.26 cents instead of 0.16 cents) of Ananatapuramu Rural Village, Anantapuramu Mandal of Ananatapuramu District.

5) In view of the above, no further orders are necessary in the Writ Petition and the same is accordingly closed. There shall be no order as to costs.
