Questioning the action of the respondents in not considering and passing orders on the explanation submitted by the petitioner, pursuant to the show cause notice issued to the petitioner to stop constructions, notwithstanding the fact that the petitioner was earlier granted permission for construction by approving the plans, the present writ petition is filed.
It is apparent from the record that on 19.10.2016 petitioner's plan was approved and he was given permission to construct diary farm and while the work is in progress, the petitioner was issued a show cause notice on 26.03.2016 to stop further constructions. Petitioner submitted an explanation on 10.04.2016 which was received by the fourth respondent on 12.04.2016.
Sri G.Narender Reddy, learned Standing Counsel, submits that necessary orders may be passed.
Considering the said submission, the Writ Petition is disposed of with a direction to the fourth respondent to pass orders on the explanation dated 10.04.2016 submitted by the petitioner within ten days from the date of receipt of the order. It is also made clear that if no orders are passed within a specified time, petitioner shall be entitled to continue constructions and complete the same without prejudice to the
rights of the fourth respondent Gram Panchayat to initiate appropriate action, if there are any violations in making constructions pursuant to the sanctioned plan.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
