ORDER:

This Civil Revision Petition arises out of order dated 20-04-2017 in I.A.No.110 of 2017 in I.A.No.846 of 2014 in O.S.No.601 of 2014 on the file of the learned VI Additional District Judge, Visakhapatnam. I have heard Mr. K. Sudershan, learned Counsel for the petitioner and perused the record.

The petitioner filed the aforementioned suit for partition of the plaint schedule properties. She has filed I.A.No.110 of 2017 for permission to amend the boundaries of certain items of the plaint schedule and also the petition in I.A.No.846 of 2014. This application is dismissed by the lower Court on the ground that the proposed boundaries sought to be included in the plaint schedule by way of amendment do not tally with the boundaries mentioned in the various documents pertaining to the items of the plaint schedule, based on which the amendment application is filed. The learned Counsel for the petitioner failed to explain whether the finding rendered by the lower Court in this regard suffers from any error.

In my opinion, when the boundaries in the documents which formed the basis for seeking amendment of the plaint schedule do not tally with the proposed boundaries in respect of certain items of properties of the plaint schedule, no purpose will be served by allowing such application. In this view of the matter, I do not find any reason to interfere with the order of the lower Court. Hence, the Civil Revision Petition is dismissed.

As a sequel to the dismissal of the Civil Revision Petition, CRPMP No.4256 of 2017 is disposed of as infructuous. ________________________ Justice C.V. Nagarjuna Reddy Date : 14-07-2017 AM
