HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7530 of 2015 ORDER :

This criminal petition is filed by the petitioner/A.4 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.166 of 2014 of Kadiri Town Police Station, Antantapur District, registered for the offences punishable under Sections 409, 408, 420 and 477-A read with 34 IPC.

2. Heard the learned counsel for the petitioner and the 1st respondent-State represented by the Public Prosecutor, before admission and before notice to the 2nd respondent and perused the material on record.

3. It is the submission of the learned counsel for the petitioner that police recently filed final report and the learned Magistrate is still has to take cognizance.

4. A perusal of the record shows that there is also accusation from the final report against the petitioner herein.

5. Having regard to the above, the criminal petition is closed with liberty to the petitioner to file a fresh petition, if advisable from the prosecution material including Part-II C.D. or on any ground after taking cognizance by the learned Magistrate.

6. Miscellaneous petitions pending, if any, shall stand closed.
