HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 28223 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in trying to dispossess the petitioners from the lands in Sy.No.633/ 2A of Peddakodapaka Village, Shayampet Mandal, Warangal Rural District, under the name of Haritha Haram, as illegal, arbitrary, unjust and unconstitutional.

2) At the time when the matter is taken up for hearing, the Government Pleader for Revenue (TG) would submit that the petitioners are not the original assignees and that they have purchased the land from the original assignees. He further submits that the assigned land is only heritable but not alienable. It is further stated that though the land was assigned for cultivation, but the same was kept idle without any cultivation. According to him, the petitioners are in un-authorised occupation of the said land.

3) Having regard to the submissions made by the learned Government Pleader for Revenue (TG) basing on the instructions received by him, the writ petition is disposed of directing the respondents to follow due process of law so as to dispossess the petitioners from the land, if they are in possession.

4) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
