THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11651 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.6 in Crime No.329 of 2023, on the file of P.S., Shamshabad, Cyberabad, registered for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C) and 29 of NDPS Act, 1985.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

Briefly, the facts of the case are that the Shamshabad Police found six persons in possession of seven packets. In the seven packets, 72 packets of Ganja was found. When weighed, the total quantity was 144Kgs. According to the investigation, accused No.1 was the purchaser of the Ganja and accused No.2 was supplier. The services of this petitioner and three others were taken for transporting the Ganja.

Learned Additional Public Prosecutor would submit that there are no other cases against this petitioner. 5.

Since it is not specifically stated as to the quantity seized from this petitioner and also for the reason of the petitioner being a woman, the prayer for regular bail is considered subject to the following conditions: i) The petitioner/Accused No.6 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, i.e. one local surety and other from the native place, for a like sum each to the satisfaction of the XIV Addl. Metropolitan Magistrate, Rajendranagar, Ranga Reddy District (Newly changed to XI Addl.

Metropoolitan Magistrate, Rajendranagar, Ranga Reddy District) Hyderabad).

ii) The petitioner/Accused No.6 after release shall appear before the concerned Station House Officer on every Monday for a period of four (04) weeks and thereafter, as and when required, for the purpose of investigation.

iii) The petitioner/Accused No.6 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
