THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11750 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking anticipatory bail to the petitioners/Accused Nos.2 and 3 in Crime No.149 of 2023 of Jainath Police Station, Adilabad registered for the offences punishable under Sections 294-B, 307, 427 read with 34 of IPC. 2.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

A complaint was lodged on 18.10.2023 by the de facto complainant viz., Ravitheja Pagadala alleging that while he and others were proceeding from Sathanala Village towards Bela, canvassing for BRS Party, these petitioners and others stopped their vehicle and picked up quarrel with them. 4.

Learned counsel appearing for the petitioners would submit that due to political rivalry, a false complaint has been lodged against the petitioners and no person was injured in the said altercation.

However, on instructions, learned Additional Public Prosecutor submitted that three persons received simple injuries.

Keeping in view that during the course of canvassing, political party altercation appears to have been taken place, this Court is inclined to grant the relief of anticipatory bail, subject to following conditions:

i) The petitioners/Accused Nos.2 and 3 shall execute personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum each to the satisfaction of Station House Officer, Jainath Police station, Adilabad.

ii) The petitioners/Accused Nos.2 and 3 after release shall appear before the concerned Station House Officer on every Monday for a period of eight (08) weeks and thereafter, as and when required, for the purpose of investigation.

iii) The petitioners/Accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
