THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26834 of 2015 ORDER:
The petitioners claim to be the owners of land in Survey No.193/1 of Vissannapeta village, Krishna District. Both of them own land of an extent of 314.6 square yards. The first petitioner is an employee in Canara Bank and the second petitioner is the father of the first petitioner. There is R & B space abutting the petitioners' land and when the said land is being used by the respondents 2 to 5, the present writ petition is filed challenging their action in erecting a transformer in a place nearer to the petitioners' land. The location of the land for erecting a transformer cannot be a subject matter of the writ petition, but the learned counsel for the petitioners states that a representation was already submitted by the petitioners on 11.08.
2015 and without hearing the petitioners and considering the said representation, the respondents 2 to 5 are going ahead with the erection of the transformer in the subject land. In the circumstances, the fifth respondent is directed to consider the representation of the petitioners dated 11.08.2015 and pass appropriate orders thereon, after hearing the petitioners, within a period of one week from the date of receipt of a copy of this order. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
