Heard.

The petitioner-Association seeks allotment of pucca houses and for that purpose, it has already filed W.P.No.1166 of 2013 and the same is pending before this Court. The petitioner has filed the present writ petition seeking to stop laying of road in Sy.No.127 situated at Borabanda Village, Khairatabad Mandal, Hyderabad.

Since the petitioner itself seeking allotment of pucca houses, until its earlier writ petition, referred to above, is adjudicated and disposed of, no rights can be claimed by the petitioner, including the right to stop laying of road. As and when the petitioner's case is considered, it may work out its remedy in terms of the orders that would be passed in W.P.No.1166 of 2013. However, the relief as sought for in the present writ petition is frivolous. Accordingly, the writ petition is dismissed. However, the petitioner is at liberty to pursue its remedy before the District Collector, Hyderabad-2nd respondent. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
