THE HONOURABLE MR JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.27845 of 2015

ORDER

Heard learned counsel for the petitioner and learned Government Pleader for Revenue for respondents.

2. Petitioner herein filed the claim petition under Andhra Pradesh (Telangana Area) Abolition of Inams Act, seeking Occupancy Rights Certificate and the same is stated to be pending in File No.J/8731/2013 before the second respondent. Petitioner, however, sought withdrawal of the said application by filing an application dated 06.06.2015 before the second respondent and complains that no orders are being passed by the second respondent. Hence, the present writ petition.

3. Learned Government Pleader for Revenue, on instructions, submits that the Revenue Divisional Officer, who was working in the office of the second respondent, has since retired and the vacancy is not yet filled up and is likely to be filled up by appointing some other Officer in the place of retired officer. Learned Government Pleader also states that as and when a regular officer takes charge of the office of the second respondent, appropriate orders on the petitioner's application will be passed.

4. In view of the limited prayer of the petitioner, the Writ Petition is disposed of, directing that as and when the vacancy in the second respondent's office is fulfilled and new officer takes charge, he shall fix an early date and pass appropriate orders on

the petitioner's application, preferably, within four weeks after taking over charge.

5. Accordingly, the Writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
