THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.28387 of 2018 ORDER:

Petitioner Company asserts that it is the financier of the vehicle bearing No.AP16 TY 4122 purchased by respondents 3 and 4. It further asserts that the said vehicle was seized by the authorities on 09.06.2016 on the ground of unauthorized and illegal transportation and that the enquiry has not yet been concluded. Its grievance is that as the subject vehicle is kept outside, being exposed to all vagaries of nature, it would be of no value with the passage of time.

Learned counsel for the petitioner submits that the petitioner is ready to deposit penalty amount of Rs.6,81,960/- so as to salvage of the vehicle and the same is evident from the letter, dated 26.06.2018 addressed by the petitioner to the second respondent - Divisional Forest Officer, Bhadrachalam Division, Bhadradri Kothagudem District.

Considering the aforesaid submission and in view of the fact that as the subject vehicle is kept outside, it would have no value after a considerable lapse of time, in the interests of justice, the second respondent is directed to release the subject vehicle to

CKR, J WP.No.28387 of 2018 the petitioner on the condition of its depositing a sum of Rs.6,81,960/- (Rupees Six Lakhs Eighty One thousand Nine Hundred and Sixty only) towards penalty and such deposit shall be subject to the final orders that may be passed in the enquiry. Subject to the above direction, the writ petition is disposed of.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
