HON'BLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL REVISION CASE No.1537 of 2015 ORDER:
This is a Criminal Revision Case filed, under Sections 397 and 401 Cr.P.C, against the order dated 27.07.2015 in Crl.M.P. No.134 of
2015 in Crl.A.No.621 of 2015 passed by the learned IV Additional District & Sessions Judge, Ranga Reddy District, L.B.Nagar, by and which the learned Additional District & Sessions Judge allowed the petition granting bail to the petitioner/accused by suspending the operation of sentence passed by the trial Court till the disposal of the appeal, subject to condition of the petitioner depositing 1/4th of the compensation amount in the lower Court and on his executing a bond for Rs.10,000/- with two sureties each for a like sum to the satisfaction of the trial Court.
2. It is contended by the learned counsel for the petitioner that the cheque amount is Rs.5,00,000/- and the trial Court was directed to pay compensation of Rs.10,00,000/- with simple interest @ 9% per annum from the date of judgment till payment of the said compensation. It is further contended that the petitioner/accused is not in a position to deposit huge amount of compensation as ordered.
3. Considering the above, it is felt necessary that the impugned order is modified to the effect that the petitioner/accused is directed to deposit the compensation of Rs.2,00,000/- (Rupees two lakhs only) to the credit of trial Court within a period of three (3) months from the date of receipt of a copy of this order.
4. With the above direction, the Criminal Revision Case is disposed of.
