THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T APPEAL No.1079 OF 2018 JUDGMENT: (per Hon'ble Sri Justice Sanjay Kumar) The District Collector and Chairman of the District Rural Development Agency, West Godavari District, and the Project Director of the said Agency are in appeal aggrieved by the order dated 12.12.2017 passed by a learned Judge of this Court disposing of W.P.No.2227 of 2001 directing the Government of Andhra Pradesh and the appellants herein to consider the case of the first respondent-writ petitioner for regularization of his services in terms of G.O.Ms.No.212 dated 22.04.1994, keeping in mind the fact that he has been working since 25 years and did not cross the age of superannuation.

We are at a loss to understand as to why the appellants are aggrieved by a direction to consider the case of the first respondent-writ petitioner in accordance with the relevant Government Order. No positive mandate has been spelt out by the learned Judge in the order under appeal whereby the appellants can claim to be aggrieved. A mere direction to consider the case of the first respondent-writ petitioner in terms of G.O.Ms.No.212 dated 22.04.1994 cannot constitute sufficient grounds for the appellants to maintain an appeal. The writ appeal is accordingly dismissed on this short ground reiterating the direction of the learned Judge to consider the case of the first respondent-writ petitioner for regularization of his services in terms of G.O.Ms.No.212 dated 22.04.1994. This exercise shall be completed expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
