THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.2590 OF 2011 ORDER:

This revision, under Article 227 of the Constitution of India, is filed questioning the order dated 19.04.2011 in I.A. No.401 and 402 of 2011 in O.S. No.105 of 2008 passed by the Senior Civil Judge, Mangalagiri.

The petitioner filed two interlocutory applications one for reopening the evidence of defendants and the other for recall of witnessD.W.2 for the purpose of marking the letter alleged to have been executed by Jonnalagadda Manikyamma in favour of the petitioner and his wife. Both these applications were dismissed by the court below. The present revision is against the order in I.A. No.401 of 2011 and no revision is pending against the order passed in I.A. No.402 of 2011.

According to Sri.R.Prasad, learned counsel for the respondents, since the order in I.A. No.402 of 2011 under Rule 17 of Order XVIII of CPC has attained finality, no purpose would be served even if the petition is allowed for reopening the evidence of defendants. Therefore, no orders are required to be passed in this revision. In view of dismissal of application filed under Rule 17 of Order XVIII of CPC and attainment of finality of such order, the civil revision petition is dismissed. No costs.

Consequently, miscellaneous petition, if any, pending shall stand closed.
