HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.26303 OF 2016 ORDER:

This writ petition is filed declaring the action of the respondents in interfering with the peaceful possession and enjoyment of the petitioners' land admeasuring Ac.2.15 guntas in Sy.No.41 in Jawahar Nagar, Shamirpet Mandal, R.R. district, as illegal and arbitrary.

Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue on instructions submits that as per the latest pahani for the year 2015-16, the land in Sy.No.41 admeasuring Ac.2-15 guntas situated at Jawarharnagar Village, Shamirpet Mandal is classified as 'Government' and the pattedar column is recorded as 'Poramboke Sarkari' and the possession is recorded as 'HMDA'. He also submits that the petitioners' father name is not found in the list of members who are eligible for grant of assignment land and that the petitioners are also not in physical possession of the said Government Land.

In the present case, though petitioner states that his father is an exserviceman and the subject land is assigned to him, no documents are filed in proof of the same.

In view of the above, I do not see any merit to entertain the writ petition. Accordingly, the writ petition is dismissed. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
