HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39332 OF 2016 ORDER:

Petitioner preferred the present Writ Petition by invoking Article 226 of the Constitution of India seeking to declare the action of the 4th respondent in trying to dispossess the petitioner from the agricultural land admeasuring Ac.1.80 cents in survey No.232/3 situated in Nuthalapadu Revenue Village of Parchuru Mandal, Prakasam District, as illegal and arbitrary. Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to consider the representation of the petitioner made on 26.09.2016 seeking issuance of patta in respect of subject land.

Learned AGP would submit that the 2nd respondent may be directed to dispose of the representation dated 26.09.2016 made by the petitioner, if the same is still pending consideration, in accordance with law.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 2nd respondent to consider the representation made by the petitioner on 26.09.2016 and pass

necessary orders thereon, if the same is still pending consideration, in accordance with law, after hearing the petitioner and the aggrieved party, if any, as early as possible, preferably within a period of eight weeks from the from the date of receipt of a copy of this order.
