HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Crl.P. No.5343 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/Accused under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.239 of 2015 of Panjagutta Police Station, Hyderabad registered for the offences punishable under Sections 376 and 420 IPC.

2) Heard learned counsel for the petitioner-accused No.1 and learned counsel for 1st respondent - de facto complainant. Perused the material on record.

3) A perusal of the record would show that both the de facto complainant and the accused, who are educated are present before the Court with the petition praying to permit them to compound the offence. In the petition there was an endorsement by the accused to pay an amount of Rs.1,00,000/- (Rupees one lakh only) to the victim and there is another endorsement either earlier time fixed for future date, victim received the amount today i.e., on 05.06.2015 as both being stated that the matter is amicably settled between them to purchase peace and marriage of the victim also settled to perform soon and the pendency of the proceedings will effect her future marital life and the career.

4) Having regard to the above and in the interest of victim compromised the matter under Section 482 Cr.P.C, though the offence under Section 376 IPC was not compoundable by virtue of this order compromised by recording the submission.

5) Accordingly, the Criminal Petition is allowed and all the proceedings relating to Crime No.239/ 2015 of Panjagutta Police Station, Hyderabad are quashed. The bail bonds of the petitioner, if any, shall stand cancelled.

6) Miscellaneous petitions, if any pending, shall stand closed.
