THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT SECOND APPEAL No.837 OF 2016 ORDER:

Vide order dated 02.01.2017, the learned counsel for the petitioners was directed to take out fresh notice to the respondent No.2 by registered post with acknowledgement due and file proof of service.

As the order of this Court dated 02.01.2017 has not been complied with, vide order dated 17.02.2017, another opportunity has been given to the petitioners. In spite of granting time to the petitioners, proof of service has not been filed till today.

Today, when the matter is taken up, neither learned counsel for the petitioners nor petitioners appeared. It seems that the petitioners are no more interested in prosecuting the case.

Accordingly, this Second Appeal is dismissed in default and for non-prosecution as well. There shall be no order as to costs.

Miscellaneous petitions, if any, pending shall stand closed.
