THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.46039 OF 2016 ORDER:

This writ petition is filed challenging the registration of crime No.46 of 2016, dated 05.10.2016, by the second respondent on the complaint lodged by the third respondent. The complaint relates to the collection of amounts by the petitioners during the years 2012 to 2014. Learned counsel for the petitioners submits that during the relevant point of time, the petitioners were office bearers of the Irrigation Scheme and hence, no complaint should have been lodged in respect of the duties discharged by them. He further submits that the present complaint is counter blast to the complaint lodged by the petitioners against some persons.

This Court cannot give a finding with regard to the above averments. However, in view of the registration of the crime, the second respondent is directed to continue the investigation, but shall not arrest the petitioners pursuant to the registration of the crime. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
