THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY Contempt Case No.335 of 2017 ORDER:

This Contempt Case is filed alleging violation of orders dated 04.07.2016 passed by this Court in W.P.No.21419 of 2016. By the above said order this Court has directed respondent No.2 therein to consider the representation dated 03.05.2016 made by the petitioner and pass appropriate orders thereon as early as possible preferably within a period of four weeks from the date of receipt of a copy of the order.

Counter affidavit has been filed by the respondents stating that in compliance of the orders of this Court the respondent - Corporation have served the notice U/s. 452(1) and 461(1) of GHMC Act, 1955 dated 11.01.2017. Aggrieved by the said action, respondent No.4 in the writ petition has approached IV Junior Civil Judge, City Civil Court by instituting O.S.No.311 of 2016 and obtained the status-quo order in I.A.No.73 of 2016 and they have filed counter affidavit and the case is pending. It is further stated that respondent No.4 in the writ petition also filed application seeking regularization of deviation vide application No. 2000105305 and the same is pending consideration. Since they have initiated action for removal of the illegal construction in compliance with the orders of this Court, there is no willful or deliberate violation of the orders of this Court.

In these circumstances, this Contempt Case is closed. However, liberty is granted to the petitioner, if any cause survives, to file fresh application seeking revival of the contempt case in accordance with law.

Miscellaneous petitions, if any pending in this contempt case shall stand closed.
