HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24887 OF 2016 ORDER:

The case of the petitioner is that the 3rd respondent issued notice dated 16.10.2002 and 02.11.2015 under Section 15 of the provisions of (AA) Estate (Abolition & Conversion into Ryotwari) Act, 1948 for conducting enquiry in respect of the land existing in Sy.No.24/6. Without concluding the said proceedings, the respondents are proceeding with the acquisition of the lands belonging to the petitioner. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue produced written instructions dated 10.08.2016 issued by Tahsildar, Obulavaripalli stating that only declaration has been published for the Land Acquisition purpose to the APMDC. Ltd and the petitioner's land admeasuring Ac.1.48 cents in Sy.No.24/3 falls under acquisition.

He also states that in respect of the remaining land involved in the petition, no action has been taken so far under new Land Acquisition Act as all the lands are classified as Government Poramboke lands. He further states that action will be initiated after finalization of the orders from the Settlement officer cum Joint collector for payment of compensation to the petitioner if the land belonging to the petitioner is taken possession as per the requisition filed by the APMDC Ltd., under rules in force. Recording the same, the writ petition is disposed directing the Joint Collector to conclude the enquiry within a period of two (02) months from the date of receipt of copy of this order. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
